You can have as many guys on roster as you want if you are out of the playoffs. The game doesn't check that you have a legal roster unless you have a game to play.

This is true, and I asked about this over at FOFC once.

I don't play in any leagues that have rules against it, but I personally will keep the final number to 53 on the active roster until the offseason.
